Terms and conditions of the XL Motors online shop<\/h5>\n
1. Applicability of general terms of sale<\/h5>\n

1.1.<\/strong> The general terms of sale apply to the legal relationship arising from the purchase of goods between XLmotors.ee customers (hereinafter the Customer) and the owner of XLmotors.ee, KNK Group O\u00dc (hereinafter XLmotors.ee).
\n1.2.<\/strong> The general terms of sale may not conflict with the legal norms in force in the Republic of Estonia and are supplemented by such norms as necessary (in the event of disputes or missing information).
\n1.3.<\/strong> In addition to these General Terms of Sale, the relationship between the Customer and XLmotors.ee is governed by XLmotors.ee product information, price list, purchase information and established good practice.
\n1.4.<\/strong> XLmotors.ee reserves the right to unilaterally change these terms and product prices for the purposes of its operational efficiency, competitiveness, further development, and the expansion or reorganisation of the product range. Changes and additions to terms and product prices take effect from the moment such information appears on www.xlmotors.ee. If the Customer submitted their order before the amendments took effect, the terms that were in force at the time the Customer submitted the order apply, unless the law or these terms provide otherwise.
\n1.5.<\/strong> XLmotors.ee and the Customer wish to trade through the XLmotors.ee website www.xlmotors.ee on the terms set out in this document. By submitting an order and making an advance payment on the XLmotors.ee website, the Customer confirms that they have read and agreed to the terms of sale.
\n1.6.<\/strong> The images next to the products are illustrative.<\/p>\n

2. XLmotors.ee price list<\/h5>\n

2.1.<\/strong> Prices of products sold in the XLmotors.ee online shop are shown in euros and do not include delivery costs.
\n2.2.<\/strong> The delivery cost depends on the delivery method chosen by the Customer when placing the order.
\n2.3.<\/strong> XLmotors.ee reserves the right to adjust prices. If the Customer submitted their order before a price change took effect, the price that was reflected on the advance invoice at the time of order placement applies.<\/p>\n

3. Shopping cart and placing an order<\/h5>\n

3.1.<\/strong> The Customer’s shopping cart is created at the moment they click the “Add to cart” button.
\n3.2.<\/strong> Adding a product to the cart does not yet oblige the Customer to purchase it.
\n3.3.<\/strong> The Customer can change the quantity of products in the cart and remove products from the cart if desired.
\n3.4.<\/strong> Products in the cart remain available to other XLmotors.ee customers until the order is confirmed.
\n3.5.<\/strong> To place an order, the Customer clicks the “Checkout” button.
\n3.6.<\/strong> When placing the order, the Customer selects their preferred delivery method and payment method and verifies the accuracy of the Recipient and Payer details.
\n3.7.<\/strong> The trouble-free delivery of purchased products depends on the accuracy of the information provided in the order. After clicking the “Proceed to payment” button, an invoice is automatically sent to the Customer’s email address.
\n3.8.<\/strong> The order is dispatched once 100% of the amount payable under the invoice has been received in the XLmotors.ee account.<\/p>\n

4. Payment for ordered goods<\/h5>\n

4.1.<\/strong> In cash or by card terminal at the shop (S\u00f5pruse puiestee 209, Tallinn).
\n4.2.<\/strong> Via Montonio Finance O\u00dc using bank link (Swedbank, SEB, Luminor, LHV Pank, Danske Pank, Coop Pank, poco pay).
\n4.3.<\/strong> By credit or debit card via Montonio Finance O\u00dc.
\n4.2.<\/strong> Once the Customer has confirmed the order, an invoice is immediately sent to the email address provided by the Customer and serves as the basis for payment.
\n4.3.<\/strong> If an order confirmation has not arrived at the Customer’s email address within 1 hour of placing the order, please contact info@xlmotors.ee.
\n4.4.<\/strong> The invoice shows the products ordered by the Customer and the contact details to which the order will be sent.<\/p>\n

5. Delivery and handover of products<\/h5>\n

5.1.<\/strong> Once the Agreement takes effect in accordance with clause 3.8 of these terms and provided that clause 1.5 is fulfilled, the products will be delivered to the address provided by the Customer in the order.
\n5.2.<\/strong> The Customer can choose between the following delivery methods: Itella Smartpost, Omniva and DPD Group parcel machine or courier. XLmotors.ee dispatches orders within 2\u20133 working days. As a rule, the dispatched goods reach the Customer on the next working day.
\n5.3.<\/strong> XLmotors.ee reserves the right to change the delivery methods.
\n5.4.<\/strong> The avoidance of delays and misunderstandings in the delivery of goods depends on the accuracy and correctness of the information provided in the order. XLmotors.ee and Omniva\/Smartpost\/DPD are not responsible for delays or misunderstandings in the delivery of products if the delay or misunderstanding is caused by inaccurate or incorrect information provided by the Customer when placing the order.
\n5.5.<\/strong> If the destination changes, XLmotors.ee asks the Customer to provide the new details as soon as possible. Once the goods have been dispatched, the destination can no longer be changed.<\/p>\n

6. Cancelling an order and returning a product<\/h5>\n

6.1.<\/strong> XLmotors.ee has the right to cancel the Customer’s order if the invoice has not been paid within 2 calendar days or within the payment term requested by the Customer.
\n6.2.<\/strong> If the goods do not fit or do not meet the Customer’s expectations, they have the right to return them within 14 days of receiving the goods. The returned goods must be undamaged, unused, with tags attached, in the original packaging and properly packaged. The money for the returned goods will be refunded to the Customer’s bank account within 2 working days, but never later than 14 working days after XLmotors.ee receives the goods. To return the goods, the Customer sends a corresponding notice to the email address info@xlmotors.ee.
\n6.3.<\/strong> The costs of returning the goods are borne by the buyer.
\n6.4.<\/strong> The costs of returning the product are borne by the buyer to the usual extent, but no more than 10 euros, except where the item delivered does not correspond to what was ordered.
\n6.5.<\/strong> If the Customer wishes to exchange the returned product for another product or for another size of the same product, the Customer pays the postage cost for the returned product. XLmotors.ee pays the postage for sending out the new exchanged product on a one-off basis. For each subsequent exchange, the buyer pays.
\n6.6.<\/strong> XLmotors.ee bears the return shipping costs if the goods have defects that could not be detected by external inspection and that did not arise from opening the package, or if the goods are not what was ordered.
\n6.7.<\/strong> If the returned product has deteriorated and the deterioration is caused by circumstances not attributable to XLmotors.ee and as a result of improper use of the product, XLmotors.ee has the right to offset the decrease in the value of the product against the amount paid by the Customer for the product and due to be refunded to the Customer.
\n6.8.<\/strong> The return form can be found here \u2013 Annex 1<\/a><\/p>\n

7. Warranty and return of non-compliant products<\/h5>\n

7.1.<\/strong> Pursuant to the Law of Obligations Act (LOA, Chapter 11, \u00a7 218 (2)), the Customer has the right to file a complaint within two years of receiving the goods. For defects occurring within the first six months, it is presumed that the defect existed at the time of purchase, and the nature of the defect must be determined by the seller.
\n7.2.<\/strong> If the defect is of a technological nature, the Customer may request the repair of the product, and if repair is impossible or ineffective, the replacement of the product. A refund can be requested if replacement has not been possible within a reasonable time due to the lack of a suitable product (LOA, Chapter 11, \u00a7 222 (1)).
\n7.3.<\/strong> If an unexpected defect occurs, the Customer must send an email to info@xlmotors.ee with the following information: Customer’s name and contact details; date of complaint; defect that occurred with the product, please also add photos; claim submitted to XLmotors.ee; invoice number, and if possible add a copy of the invoice.
\n7.4.<\/strong> XLmotors.ee is not liable for:
\n7.4.1.<\/strong> damage to the product caused by the fault or negligence of the Customer;
\n7.4.2.<\/strong> natural physical wear and tear of the product under normal use.<\/p>\n

8. Liability and force majeure<\/h5>\n

8.1.<\/strong> XLmotors.ee is liable to the Customer for damage caused by XLmotors.ee’s breach of these terms in the cases and to the extent provided for in the legal acts in force in the Republic of Estonia.
\n8.2.<\/strong> The Customer is liable to XLmotors.ee for damage caused by the Customer’s breach of these terms in the cases and to the extent provided for in the legal acts in force in the Republic of Estonia.
\n8.3.<\/strong> Neither party is liable to the other party, and their conduct is not regarded as a breach of these terms, for delay or failure to perform any obligation where the cause of such delay or failure was beyond that party’s control (force majeure).
\n8.4.<\/strong> XLmotors.ee does not compensate for moral damage that may be caused to the Customer by changes to delivery times, prices and other terms within the scope of these terms.
\n8.5.<\/strong> XLmotors.ee does not compensate the Customer for costs arising from the Customer having assumed obligations towards third parties (independent of XLmotors.ee) on terms that conflict with these terms.
\n8.6.<\/strong> XLmotors.ee does not compensate the Customer for missed opportunities resulting from changes to delivery times, prices and other terms.<\/p>\n

9. Other terms<\/h5>\n

9.1.<\/strong> XLmotors.ee uses the personal data provided by the Customer only to fulfil the Customer’s purchase order. The data is treated confidentially and is not disclosed to third parties, except where the delivery method chosen by the Customer requires it and in cases provided by law.
\n9.2.<\/strong> XLmotors.ee reserves the right to send the Customer information about new products and special offers if the Customer has subscribed to the XLmotors.ee newsletter. The Customer has the right to request the deletion of their data from the XLmotors.ee database.
\n9.3.<\/strong> Matters not regulated by these terms are governed by the Customer and XLmotors.ee in accordance with the legislation in force in the Republic of Estonia and other acts governing the relations between the parties.
\n9.4.<\/strong> Any differences of opinion and disputes arising from the performance of these terms are resolved by the parties primarily through negotiation. If disputes arising from the Agreement cannot be resolved by negotiation between the parties, both the Customer and XLmotors.ee have the right to protect their rights by turning to the Consumer Protection Board or the court.<\/p>\n

10. Delivery<\/h5>\n

10.1.<\/strong> For products in stock, the delivery time is 1\u20134 working days.
\n10.2.<\/strong> For individual orders, the delivery time depends on the nature of the goods.
\n10.3.<\/strong> The maximum delivery time for goods is 14 working days.<\/p>\n

11. Dispute resolution<\/h5>\n

11.1.<\/strong> If the buyer has any complaints about the Online Shop, they should be sent to the email address info@xlmotors.ee <\/span>or call: +372 53801942. If the buyer and the Online Shop cannot resolve the dispute by agreement, the buyer has the option of turning to the Consumer Disputes Committee. The procedural terms can be viewed and a complaint can be submitted <\/span>here<\/strong><\/a>. The competence of the Consumer Disputes Committee is to resolve disputes arising from the contract concluded between the buyer and the Online Shop. The review of the buyer’s complaint by the committee is free of charge. The buyer may turn to the European Union consumer dispute resolution platform. Estonian law applies to the terms of ordering and to the purchase and sale agreements of the XLmotors.ee online shop. If any provision of the terms of ordering is void, this does not affect the validity of the remaining terms of ordering or the purchase and sale agreement. The void provision is replaced by a lawful provision that is legally and economically closest to the void provision.<\/p>\n

12. Final provisions<\/h5>\n

12.1.<\/strong> These terms of ordering and the purchase and sale agreements of the XLmotors.ee online shop are governed by Estonian law. If any provision of the terms of ordering is void, this does not affect the validity of the remaining terms of ordering or the purchase and sale agreement.
